The Overseas Chinese Democracy Coalition is outraged about and condemns the detention of the pro-democracy activist YANG Tianshui in HangZhou on Christmas Eve, December 24, 2004. This continued crackdown of the Chinese government once again shows the true face of the new leadership.
Mr. Yang is an outstanding writer, covering a wide range of topics including poems, novels, political commentaries and translated work. He is also a pro-democracy leader and thus suffered through 10 years of sentences and torture. Nevertheless, he kept his democracy and human rights beliefs after being released from jail. He is a warm-hearted person who is very considerate and encourages the other dissidents to be strong.
The coalition is especially saddened that, only a few hours after Mr. Yang gave us permission to publish his article on another human rights defender who suffered through tortures and is thus handicapped, he himself may have a similar fate now. Our latest hourly report indicated that Yang is supposed to have been transferred to Nanjing, his home city, although he has not showed up at his home and his family members have not been able to contact him.
The Overseas Chinese Democracy Coalition will keep vigilant on the ongoing suppression of Chinese dissidents, especially during the holiday season, and will keep calling for international attention as well.
Hereby, we release a letter of appeal for a signature drive that was initiated by our democracy advocates inside China in an effort to call for Yang's immediate release.

Appealing Letter Calling for Signatures
In Protest of the Chinese Police illegally detain Yang TianShui and Abuse His Human Rights
Dear friends,
We learned that at 7pm last night (i.e. December 24, Christmas Eve), simply by using the excuse of "an oral summons to court", Zhejiang police forcefully brought Yang TianShui away and detained him in some secret place in HangZhou, without allowing any visitors including family members and friends. After 15 hours, they suddenly informed his relatives that Yang was not allowed to stay in Zhejiang Province anymore and a special escort from the police sent Yang directly to Nanjing of Jiangsu Province as a prisoner. Until now, Yang has not gained his freedom.
We protest this abuse of human rights and call for the immediately release of Mr. Yang TianShui. We also protest the illegal procedures in this incident which violate even Chinese law, such as the illegal use of the "oral summons", the surpassed legally defined time of 12 hours, the secret manner of such a summons, including refusing to provide the place and police department which is responsible to his relatives, the forceful relocation of Yang without his consent...
Hereby, we protest the police' abuse of their power and ask for the promise of "respect and protection of human rights" in this incident, along with the recent series of detentions and abuses of Shi Tao, Liu Xiaobo, Yu Jie, Gu Zexu, etc. by the police in other parts of China. We are afraid that the human rights condition in China is on a backwards track again and the darkness of suppressing the intellectuals common in the Mao Zedong time has come back as well. It is our grief that within such a vest country, there is no place for an intellectual with dignity to stay.
Hereby, we are calling all the righteous forces both inside and outside China to unite together, in an effort to stop this type of ridiculous suppression of political dissidents and intellectuals. We eagerly call for international society to pay attention to what the Chinese government has been carrying out recently with the well-planned suppression against its dissident intellectuals. Please, let us act together to prevent the human rights condition deteriorating in China!

中国民主运动海外联席会议对2004年12月24日晚杨天水先生在杭州被警方违法“口头传唤”并强行从住所带走表示愤慨。 这一天来有关情况的进展再次展示了中共新政权镇压人权的真面目。自从当局最近一波对异议人士的镇压行动展开以来，杨天水是继师涛、刘晓波、余杰之后被捕的第四位自由作家。
杨天水是独立中文作家笔会的会员，是一位才华横溢的作家，发表于互联网上的作品有数十万字。他的作品涉猎广泛，包括诗歌、小说、政论和翻译作品。杨天水还是一位资深民运人士。六四之后，他对当局血腥镇压民主运动强烈愤慨。激于义愤，他曾经在江苏建立过一个成员很多、包括一些现役军官的地下民运组织，后遭当局野蛮镇压。作为这个组织的领导人，杨天水先生被判处10年徒刑，关押于南京龙潭监狱，受尽了折磨。出狱之后，杨天水先生不改初衷，继续致力于推动中国民主化进程，不遗余力。他一面从事写作，抨击时政；一面到处奔波，看望各地的民运人士，给大家送去温暖和激励。
令人感叹的事，在给与我们准许发表他有关被折磨至残的浙江民运人士陈龙德的文章几小时后，杨天水先生又一次为他的正直与正义踏上了相似的路程。他被如同押送犯人一样，专车专人直接押送往江苏南京。至今没有自由。

强烈抗议警方执法违法侵犯人权迫害杨天水！坚决制止中国复辟倒退走回头路！！

惊悉昨天（12月24日）圣诞夜约19点，浙江警方悍然以所谓的“口头传唤”为名，把杨天水先生从浙江杭州市郊的住处强行带走，关押于警署之中，并且关押地点对杨的亲属保密，也不准杨的亲友看望。如此“秘密”关押约15个小时之后，时至今天将近中午时分，又突然通知杨天水亲属，说警方已经决定不准杨天水继续居住在浙江境内。随后，竟然多名警察，如同押送犯人一样，警方专车专人把杨天水直接押送往江苏南京。而且，直至现在，已经是12月25日半夜了，杨天水仍然没有获得自由。
我们强烈抗议浙江警方这一执法违法公然践踏法律侵犯人权的可耻行径！
我们强烈呼吁最高当局立即责令有关部门立即纠正这一荒唐的严重违法侵权事件！立即恢复杨天水先生的人身自由！立即解除对杨天水先生的这一严重迫害！！
1.浙江警方对杨天水先生的这一“口头传唤”，适用错误，所以警方程序违法。众所周知，所谓“口头传唤”，一般仅适用于警方处理“来不及办理传票的急发事情”之类少量特殊情况。而从以上介绍的浙江警方这次对杨天水的做法全过程以及我们从中可大致窥知的警方意图目的，等等，可知，“口头传唤”显然并不适用于浙江警方的这次行动。
2.浙江警方对杨天水的这一“口头传唤”，竟然持续长达15个多小时，严重超时，所以警方时效违法。因为任何传唤，法定时效不可超过12个小时。
3.浙江警方对杨天水的这一“口头传唤”，竟然“秘密”进行，所以警方的实施方式违法。因为任何传唤，必须将传唤进行的地点与实施部门告知被传唤人亲属。但浙江警方的这一所谓“口头传唤”，却拒绝告知任何此类有关情况。
4.浙江警方将杨天水“驱逐”出（浙江）境、押送江苏南京的做法，严重违法违宪。虽然杨天水的户籍所在地为江苏，但作为正在正常生活的自由公民，只要本人愿意，杨当然可以居住中华人民共和国境内任何普通地区生活，这是我国现行宪法与法律所保障了的人所共知的公民基本权利，任何人无权干预、更无权以押送出境的方式强行剥夺这一权利。
5.浙江警方以上知法违法、执法违法，将杨“驱逐出境”做法的深层原因，无非因为杨天水是一个著名政治异议独立作家，是一个著名民运人士，而杭州又恰巧是政治“敏感”地带或全国民运中心之一。警方视杨在杭是“如鱼得水”，所以如此不惜践踏法律将杨强行驱逐出境。
6.浙江警方以上知法违法、执法违法做法的实质，是严重侵犯人权，是敌视或蔑视、并且严重迫害政治异议人士。因为任何公民居住自由，是我国现行宪法保障的基本人权之一，因此，也是各级政府包括警方必须承认并予以保障的公民基本人权之一。
7.江苏警方也涉嫌违法。因为浙江警方最迟应该在25日下午3点左右已经将杨天水先生押送到了南京，而杨天水却直至现在仍然没有获得自由。这只能认为杨天水现在正被南京警方关押在某处。但南京警方继续关押杨天水是完全没有道理的。
我们强烈抗议警方违法侵权迫害杨天水！我们愤怒谴责警方敌视或蔑视、歧视、并且如此严重迫害政治异议人士的荒谬行为！愤怒谴责警方藐视并违反宪法与法律！我们强烈要求立即恢复杨天水的人身自由！立即恢复杨天水的自由居住权！！
我们强烈呼吁最高当局立即兑现“法律面前人人平等”、立即兑现“尊重和保障人权”等重要承诺，立即纠正并制裁敌视或蔑视、歧视、以及严重迫害政治异议人士的此类荒唐行政行为！
联系到不久前长沙警方逮捕师涛，北京警方传唤并抄家刘晓波、余杰，以及上海警方传唤顾则徐并非法扣押电脑的种种迫害知识分子、企图大搞文字狱、以言治罪的荒谬做法，我们不由感到：中国正在开历史倒车，毛泽东年代残酷迫害知识分子的黑暗正在慢慢笼罩中国。在人类已经进入了21世纪新文明的今天，中国却正在可悲地复辟“文革”！诺大的一个中国，竟然已经荒谬到了没有正直知识分子的立足之地了。
是可忍？孰不可忍！我们紧急呼吁海内外一切正义力量联合起来，坚决反对一切诸如此类迫害政治异议知识分子的荒谬行政行为！我们紧急呼吁国际社会密切注意中国正在有计划有步骤地迫害政治异议知识分子这一严重侵犯人权情况!我们紧急呼吁国际社会一致行动起来，坚决制止中国复辟倒退走回头路！！
