Wife Fang Cao and Friends of Conscience Appeal for the Release of the Innocent Freelance Writer, Mr. ZHANG Lin

 

 

Editor's note:

 

We are very concerned about the recent staged persecution against the well-known freelance writer Mr. Zhang Lin, along with many others, and we appeal for the international attention here.

 

Because of his writings, especially on the subject of Chinese workers' protests, Zhang Lin has been harassed by the Chinese police all the time.

 

On January 21, just a few days before his arrest, Mr. Zhang sent his last SOS message to this editor as "they interrogate me everyday and repeatedly said that they will arrest me if I write anymore." 

 

On January 27, having just came back from Beijing with the intention to mourn the death of Zhao ZiYang, the Chinese leader who refused to kill the demonstrators in Beijing in 1989, Zhang Lin was taken away from the train station on the charge of "administrative detention" due to "writing bad articles".  The "administrative detention" has a maximum legal duration of 15 days. 

 

On February 6, police came to Zhang's home, searched, and took away items such as a borrowed computer.

 

On February 13, Zhang's wife, Ms. FANG Cao went to the police station to pick up her husband.  But the detention had been changed to "criminal detention" due to "multiple offenses".  Zhang Lin was driven away from the police station in front of his wife without ever being allowed to meet or talk to his wife.  Friends were all outraged. 

 

For the last week, although we received timely updates constantly, we could not get much about what had happened to Zhang Lin.  Now, the reputed human rights lawyer Mr. Guo GuoTing just arrived in BangBu City to represent Zhang Lin, but the police are using all the excuses for refusing to let them meet.

 

It is still the Chinese New Year celebration period, yet many families in China such as Zhang Lin's have nothing to celebrate without their loved ones.  The 61th United Nations' High Commission on Human Rights session is going to start in less than one month, yet the Chinese government has only turned up its suppression on its people. 

 

Hereby, we present a brief translation of the letter written yesterday by Ms. FANG Cao, Zhang Lin's wife, in a hope that more people will pay attention and more help could be provided.  For more information and details about Zhang Lin's case and others, please refer our Chinese version, where we also include several articles of appeal from friends of conscience, one of them is written today by Mr. YANG TianShui which described the detail effort Zhang's lawyer Guo GuoTing has given.

Letter from Zhang Lin's Wife, Fang Cao

 

February 20, 2005

 

 

After Zhang Lin was detained for 15 days on the "administrative detention" charge, I thought I would be able to see him finally.  When I arrived (at the police station), I received the "criminal detention notification" in the name of "multiple offenses".  My expectation turned into ice immediately.

 

Since last year, Zhang Lin has communicated about and reported to the international society on the demonstration of the Chinese workers.  For that, he was beaten up by "Chinese Mafia" and received warnings from the government.  The government forbade him to write anymore articles, and even nonsensely required him to get their approval before going out.  On January 27, Zhang Lin and Wang TingJin went to Beijing in an effort to mourn the death of Zhao ZiYang.  They were unable to do so due to various obstacles.  When they returned to BangBu at 11am of the 29th, Zhang Lin was taken away by the police again as soon as he got out of the train station.

 

I have not seen Zhang Lin for nearly one month, and really want to know his current well-being.  For the last a few days, the weather was so cold that it made a record for the last decade, which makes me worried that his illness due to his time at the "re-education through labor" camps might come back.  Our two-year old daughter keeps asking for daddy everyday.  On the day of the Chinese New Year, we had a "get together dinner" at my mother-in-law's home with a vacant seat for Zhang Lin... 

 

I have felt sad for him, his best youthful eight years being spent in the dark prisons.  Every time I read his long autobiographic literature of himself, "The Sad Spirit", and I go through the detailed pain and torture he suffered through during those eight wrongfully treated years, my heart aches.  How much youth could one person have?  How many eight years one's life has?  Many times, Zhang Lin has told me that his happiest time is the time being with me.  Every time I heard that, I swore to myself that I shall help him to catch his lost happiness in the past and not to let him to be lonely and in pain anymore.  Now all the beautiful wish is shattered again.  My sun is gone.  My sky is dark.  The husband who should be home to take care of the family, the Zhang Lin who writes wonderful articles, has lost his freedom again.  Now, all he could do is to picture the family get-together while he was locked behind the chilly and cold bars.

 

In the darkness, I still see some light.  I know many people of conscience, the media, and the international human rights organizations are working hard to rescue him.  Here, I want to give my special appreciation to Mr. LIU XiaoBo, Lawyer GUO GuoTing, Mr. YANG TianShui, Mr. XU WangPing, Ms. Ciping HUANG, Ms. SHENG Xue, Ms. XIN Fei.  I thank you for your helping hands.  I also wish the international media, related international organizations, various comrades and friends to give all forms of help, in an effort to rescue my husband Zhang Lin.  I want to use this famous P.B. Shelley’s poem to describe my confidence: "If winter comes, can spring be far behind?"

关于上月张林先生的被抓,已有一些中文报道及呼吁文章,但英文的很少。此期,我们将有关张林的情况以英文方式向国际社会与人权团体介绍,并附以张林太太方草的让人动情的文章(英文简译)。

 

在第六十一届联合国日内瓦人权会议即将召开之际,中共不顾国际社会的关注与批评,在国内进行进一步的镇压。这两个月来更是变本加厉,做出一系列千夫所指的事情来。希望国内外大家联合起来,共同揭露并谴责中共,推动人权进步。

 

在中文版里,我们将方草女士的原文及近期其它朋友们有关张林的文章附上,以求大家对张林先生有更深刻的了解。

张林太太方草呼吁国际社会关注被拘留多日的张林先生

 

 

张林被"行政拘留"十五天之后,我以为可以见到我的夫君,可就在我满怀欣喜去接张林的时候,"多次作案"的刑事拘留通知书又摆在我的眼前,让我欣喜的心情,一下子凉到了冰点。

 

自从去年张林向国际媒体报道了蚌埠工人示威游行,及他被黑社会绑架殴打事件之后,就受到了当局严重的"红牌"威胁。当局不允许他发表任何一篇文章,并毫无理由地规定他就连外出也要经过他们的批准。2005127日,张林和王庭金去北京参加中国当代杰出政治家赵紫阳先生的追悼会,因当局种种阻碍未果。他俩于29日早上11点回到蚌埠,一出火车站,张林没想到迎接他的是又一次牢狱之灾。

 

现在我和张林有二十多天没见面了,我很想知道他的状况。这几天雨雪不断,天气异常寒冷,是十几年来少有的严寒,我担心他的劳改后遗症是否又犯了。两岁的女儿安妮每天都天真地问我:"我问你,爸爸呢,爸爸到哪里去了?"我就对她说爸爸上班了,挣钱给安妮买好吃的,她总是特别高兴。看着女儿高兴样子,我心里有说不出的伤感。春节那天,我在婆婆家里,大家坐在一起,看着给张林留的餐位,我多希望此刻他就和我们在一起,一大家人开开心心过一个欢乐新年啊!可是"便插茱萸少一人",他的餐位上只有一副空着的碗筷。有时我也为夫君感到惋惜,因为他八年最美好的青春时光都是在黑狱中度过的。每一次我读到他的长篇自传体纪实文学《悲怆的灵魂》,看到他在书中所记录的那些他在八年冤狱中遭受过的无数痛苦和折磨,心中就痉挛般地疼痛。人生能有几度青春年华?一生又有几个八年?张林曾经多次跟我说过,他最幸福的时光是和我在一起的日子,每当他说这些时,我就暗暗发誓,我要弥补他以前失去的幸福,让他以后不再孤单,不再痛苦,一辈子幸福。可是美好的愿望眼下又被打碎,我的太阳走了,我的天空黑暗了,本应在家主事的夫君,本应在家里妙手着文章的张林,现在又一次失去了自由,只能在冰冷的铁窗后面用想像去遥望万家团圆的灯火。

 

黑暗中我还是看到一线光明,看到很多正义人士、媒体、国际组织正在为营救张林出狱而努力。在这里我要特别感谢刘晓波先生,郭国汀律师、杨天水、许万平先生、黄慈萍女士、盛雪女士、辛菲女士。我非常感谢你们,也感谢其他诸位伸出援助之手的朋友。同时盼望国际媒体、相关国际组织、各界同志和朋友继续给予各种形式的道义上的援助,援救我的夫君张林。我的信心就像雪莱的名句所言:"冬天到了,春天还会远吗?

张林受到更严重的迫害 -- 呼吁签名声援张林的公开信

 

 

半个月前张林先生等前往北京,意图参与悼念中共前总理、前总书记赵紫阳先生并参加遗体告别的仪式,受到北京官方的阻挠,返回蚌埠之后,立刻受到拘禁,蚌埠市公安局随便找个理由,就对他实行行政拘留十五天,到今天上午已经期满,九点左右,张林的太太方草和张林的亲密道友王庭金先生,前往蚌埠市公安局拘留所迎接张林先生。他们看到的不是张林获得自由,而是蚌埠市国保大队的一辆囚车载着张林,开出拘留所。芳草得到告知:张林已经转为刑事拘留,告知书上写着:多次作案。当方草和王庭金二人多次责问有关办案人员,要求给予明确理由之后,他们才答复说:“张林涉嫌危害国家安全罪。”

 

按照中共的法律,一般犯罪嫌疑人的刑事拘留是七天之内;有三种情况,即所谓的流窜作案、多次作案、团伙作案,可以延长二十三天,即总的刑事拘留期限是三十天之内。看来这次限制张林的自由最起码是三十天。更败坏的是,这样的司法程序,经常被胡乱加到良心公民的头上,被扭曲为限制或剥夺他们自由的橡皮筋式的工具。

 

根据了解,我们原先推测主要是蚌埠市警方报复张林先生的看法,并不完整。因为就在前几天,当方草责问蚌埠市警方为什么总是无辜关押张林,警方有关人员回答说:“北京公安部已经责备我们,说你们蚌埠市还管不管张林,再不管,我们就管了。”如此看来,连续变更强制措施,已经不仅是蚌埠市警方的意图了,而是这个国家专政机器从中央到地方的联合行动。

 

张林先生,是我们熟知的良心公民,自由作家,民运斗士,他和仍然被关押在监狱的胡石根先生、秦永敏先生、刘贤斌先生、师涛先生、陈西等许多追求人道、民权、自由、平等、博爱、公正的良心公民一样,牺牲了个人的、家庭的幸福,经历了众多经济的、精神的、肉体的痛苦,总是将抵制专制腐败、复兴中华民主的大业放在首位。因此他们总是中国大陆守旧力量非常仇视的对象,当局为了自己眼中所谓的“稳定”,他们就经常遭到各种形式的拘禁、关押、监禁。

 

张林先生是个优秀的良心公民,他有百折不挠的斗志,痛快淋漓的笔法,滔滔不绝的口才,不怕高压的正气。凡是认真阅读他文章的人,一定会看到他非凡的智慧,他对腐败、愚昧、麻木、不仁的义愤,他对中华社会进步事业的使命感和献身精神。这里需要特别提及的是:他的抨击专制腐败的文章,拥有迫击炮一样的威力;他追求人道、自由、民主的信念,犹如岩石一样坚固,多少次牢狱,多少次肉体的摧残,都不能磨灭之。

 

为了这样的信念,八九民运以来,他陆续遭到判刑两年、先后劳教六年的迫害,至于传唤、软禁、恐吓等等,就无法记数了。为此,他经历过妻子离散的苦难。但是,他从未退缩,总是一如既往,在苦海中继续为中华的整体幸福苦战。

 

在他的理念世界中,无论什么人,无论属于什么党派,只要他走向自由民主,都值得尊重和拥护。正是这种宽容的精神作为心灵支柱,使得他几年来和国内很多朋友都能够理性交流,友好相处;也正因为这样宽容精神作为心灵支柱,他比很多共产党人还要积极万分,一直以各种方式悼念并倡导大家悼念值得尊重的也值得拥护的中共前总理总书记赵紫阳。

 

张林先生一贯站在多数国民的立场之上,当然是站在特权群体以外的多数国民立场之上。如果不信,那么就实行全民公投好了。如果真的实行全民公投,其结论一定会使守旧派及其帮闲群体大吃一惊—多数国民对他们的痛恨已经如山如海了。

 

正因张林为一贯坚持道义立场,所以中国大陆政权上上下下的当权派就一直仇视他、嫉恨他,必欲置之于死地而后快!

 

我们呼吁,所有良心未泯的人类成员,只要你能够看到这个呼吁书,那么请你义无返顾地站出来,声援张林这样优秀的良心公民。我们一起强烈谴责中国大陆当权派的政治上的倒退吧!我们一起强烈要求蚌埠警方尽快释放张林先生!一起强烈要求中国大陆的当权派释放所有被关押的良心公民!

蚌埠市警察的欺骗

 

 

00五年二月二十一日下午四点半左右,我接到坚定而著名的维权律师郭国汀先生从蚌埠市打来的电话,他说:“我遭到了拒绝。蚌埠市的警察在回避我。”我知道他所说的遭到拒绝,一定是他到了蚌埠,想会见自己的当事人民主斗士张林先生的要求遭到拒绝,所谓回避,肯定是蚌埠市警方以种种借口,推延时间,耗费国汀律师的时间和精力,并以此表明他们对民主宪政潮流的坚决抵制。

 

我请郭国汀先生详细介绍经过,他说:“按照法律,一个受委托的律师,如果向司法机构交涉,要会见自己的当事人,有关的司法机构,必须在四十八个小时内作出安排。为了防止意外,我于上个星期五(二月十八日)的下午三点左右,就向蚌埠市的公安局发送了传真,将我要求会见我的当事人张林先生的要求,传达了过去。但是至今还没有获得任何答复。今天下午,我从上海到了蚌埠市,电话沟通蚌埠市公安局国保大队的具体负责张林案件的警察胡同君,回答说他出差了。看来他们是在故意拖延回避,而且和江苏警方相比,又有很大的差距。”

 

我想尽管江苏和这里比,要好些,但是江苏那里,上次在国汀先生接受我法律咨询的见面事情上,同样前后拖延了三天,同样浪费了国汀先生很多精力和时间,而且江苏警方那样做,表明他们把国家的法律完全当成一党私家的法律。今天蚌埠市警方,同样要重演这样的荒唐戏剧了。

 

真的是出差吗?我们难以相信。中国大陆很多被监禁过的国民,有这样的体会:警察哄死人不抵偿。意思是说,大陆警察为了执行任务,随便如何撒谎,都在所不惜。但是我们也不能一概而论,是否蚌埠市国保大队的胡同君先生,真的有什么要紧的打压民运的案件在身,有事外出?为此,我电话询问了张林先生的好友,也是民运难得的坚强的斗士,前物理教师王庭金先生,他说:“我电话问了胡同君爱人,她说胡根本没有出差。"

 

接着电话里,我和张林太太方草进行了短暂的沟通,首先感谢她作为一个普通的女人,写出那样优美真挚的文章,支持他的丈夫,同时得知郭国汀律师,王庭金先生,方草女士,明天会继续依法努力,争取见到目前被监禁在蚌埠市公安局看守所里,很有可能遭遇大量暴力侵犯的张林先生。
